These Terms of Service (“Terms”) govern your use of the website and services provided by Caldera Cybersecurity Services LLC (“Caldera Cybersecurity,” “Company,” “we,” “our,” or “us”).
By accessing or using our website or services, you agree to these Terms. If you do not agree to these Terms, you should not use our website or services.

You agree to use our website and services only for lawful purposes and in accordance with these Terms.

Caldera Cybersecurity provides cybersecurity consulting, assessments, advisory services, technology services, and related business services designed to help organizations manage cybersecurity and technology risks.
The specific scope, pricing, responsibilities, deliverables, and other terms applicable to professional services may be established in a separate agreement, statement of work, order, proposal, or similar document.
If a separate written agreement conflicts with these Terms regarding a specific paid service, the terms of that separate agreement will control with respect to that service.
3. SMS Messaging Terms and Conditions
Program Name: Caldera Cybersecurity Services LLC SMS Messaging Program
Caldera Cybersecurity uses SMS to support one-to-one conversational business communications between authorized Caldera Cybersecurity employees and customers, prospective customers, vendors, partners, and other business contacts.
Types of Messages
SMS messages may include:
- Responses to inquiries
- Appointment and meeting coordination
- Appointment confirmations and scheduling changes
- Follow-up regarding information or services you requested
- Questions and responses concerning cybersecurity services
- Service-related information and updates
- Other one-to-one business communications related to your interaction or relationship with Caldera Cybersecurity
This conversational SMS program is not intended for bulk SMS marketing, broadcast messaging, automated alerts, or API-generated messaging.
How Users Opt In
Recipients may consent to SMS communication through our website or directly during a business interaction with an authorized Caldera Cybersecurity representative.
When website-based SMS consent is used, the applicable SMS consent checkbox is unchecked by default and must be actively selected before the form is submitted.
For one-to-one conversational business messaging, a recipient may provide a mobile telephone number and request or agree to communicate with a Caldera Cybersecurity representative by text message in connection with an inquiry, appointment, requested service, existing business conversation, or other direct interaction with us.
Providing a telephone number alone does not constitute consent to receive promotional or bulk marketing SMS messages.
Consent to SMS messaging is not a condition of purchasing goods or services from Caldera Cybersecurity.
Message Frequency
Message frequency varies depending on the nature and duration of your business conversation and interaction with Caldera Cybersecurity.
Message and Data Rates
Message and data rates may apply. Your wireless carrier’s standard messaging and data charges may apply to SMS messages sent or received.
Opt-Out
You may stop SMS communications at any time by replying STOP.
After you opt out, you may receive a final confirmation message indicating that you have been unsubscribed. No further SMS messages covered by that consent will be sent unless you subsequently opt in again.
We will also honor reasonable requests to stop SMS communications made directly to a Caldera Cybersecurity representative or through our published contact information.
Re-Enrollment
If you have previously opted out, you may be required to provide consent again before SMS communications resume. Where supported, you may be asked to reply START to re-enable SMS messaging.

Carrier Disclaimer
Wireless carriers are not liable for delayed or undelivered messages. Message delivery depends on your wireless carrier and network availability and cannot be guaranteed by Caldera Cybersecurity.
Mobile Information and Privacy
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
Mobile telephone numbers, SMS opt-in information, and SMS consent records will not be sold, rented, or provided to third parties or affiliates for their own marketing or promotional purposes.
Information may be provided to telecommunications carriers, messaging providers, technology providers, and other service providers solely as necessary to transmit and support SMS communications and operate the service.

4. Employee Communications
Caldera Cybersecurity employees may separately receive work-related SMS communications for legitimate business and operational purposes, including scheduling, security, administrative, and internal communications.
Employee communications are separate from the customer-facing conversational SMS program described above and may also be governed by employment policies, procedures, or agreements.
5. Intellectual Property
Our Limited License to You
Unless otherwise stated, content on our website, including text, graphics, logos, designs, documents, software, and other materials, is owned by or licensed to Caldera Cybersecurity and is protected by applicable intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable right to access and use our website for lawful personal or business informational purposes.
You may not reproduce, distribute, modify, publish, sell, license, or otherwise exploit our website content without prior written permission except as permitted by law.
Materials You Provide to Us
If you voluntarily submit feedback, comments, suggestions, or similar materials to us, you represent that you have the right to provide those materials. We may use such materials for legitimate business purposes, subject to applicable confidentiality obligations and our Privacy Policy.
This provision does not grant us ownership of customer confidential information or intellectual property provided to us under a separate services agreement.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR WEBSITE AND GENERAL WEBSITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
WE DO NOT WARRANT THAT THE WEBSITE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
Specific warranties, commitments, or service levels applicable to paid professional services, if any, will be governed by the applicable services agreement or statement of work.
11. Cybersecurity Disclaimer
Cybersecurity risk cannot be completely eliminated. Unless expressly agreed otherwise in writing, our services do not constitute a guarantee that a customer will not experience a cyberattack, data breach, security incident, regulatory issue, technology failure, or other loss.
Recommendations and assessments reflect the information, circumstances, scope, and technology available at the time the services are performed.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CALDERA CYBERSECURITY SERVICES LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE WEBSITE.
Limitations of liability applicable to professional services will be governed by the applicable services agreement, statement of work, or other written agreement between the parties.
Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
13. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Caldera Cybersecurity Services LLC and its officers, employees, contractors, and agents from claims, liabilities, losses, and reasonable expenses arising from your unlawful misuse of our website, your violation of these Terms, or your violation of another party’s rights.
14. Termination
We may restrict or terminate access to our website or services where reasonably necessary because of unlawful conduct, security threats, abuse, violation of these Terms, or other conduct harmful to Caldera Cybersecurity or others.
Termination of professional services will otherwise be governed by the applicable services agreement.

We may update these Terms periodically. Changes become effective when the revised Terms are posted on this page unless otherwise stated.

16. Governing Law
These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles.
Except where another written agreement provides otherwise, disputes relating to these Terms will be subject to the jurisdiction of the applicable state or federal courts located in New Mexico.
17. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
18. Entire Agreement
These Terms, together with our Privacy Policy and any applicable written services agreement, constitute the applicable agreement concerning your use of our website and services.
For professional services governed by a separate written agreement, that agreement controls to the extent of any conflict with these general website Terms.
